What evidence is required to prove 'Extraordinary Ability'?
You must demonstrate sustained national or international acclaim. This is done by meeting at least 3 of 8 specific criteria, such as receiving nationally recognized prizes, membership in exclusive associations, published materials about you in major media, original contributions of major significance, or commanding a high salary. Alternatively, a one-time major achievement like a Nobel Prize or Oscar is sufficient.
Can I apply for an O1 visa as a freelancer or self-employed individual?
You cannot self-petition; you must have a U.S. petitioner. However, if you are a freelancer (common in the arts), you can use a U.S. Agent as your petitioner. The agent acts as a representative for you and your multiple employers, allowing you to work on various projects or engagements without being tied to a single employer.
How quickly can an O1 visa be approved?
