Frequently Asked Questions

Get answers to common J1 visa questions

What makes the J1 Exchange Visitor Visa unique?

The J1 visa is a broad category designed for individuals approved to participate in work-and-study-based exchange visitor programs. It covers 15 diverse categories including Au Pairs, Summer Work Travel, Interns, Trainees, Physicians, and Research Scholars. The primary goal is cultural exchange, fostering mutual understanding between the U.S. and other nations.

What is the 'Two-Year Home-Country Physical Presence Requirement'?

Some J1 holders (specifically those with government funding or specialized skills needed in their home country) are subject to Section 212(e). This rule requires you to return to your home country for at least two years after your program ends before you can apply for an H, L, or K visa or Permanent Residency. Waivers are available but can be complex to obtain.

Can I legally work in the U.S. on a J1 Visa?

Yes, but your employment is strictly limited to the specific program sponsor and activity outlined in your Form DS-2019. For example, an Au Pair can only work for their host family, and an Intern can only work for their designated host employer. Unauthorized employment outside your program is a serious violation of status.

Can my spouse work while accompanying me on a J2 visa?

Yes, this is a significant advantage of the J visa category. Spouses and unmarried children under 21 holding J-2 status may apply for an Employment Authorization Document (EAD) from USCIS. Once approved, they can work for any employer in the U.S., full-time or part-time, for the duration of your J1 status.

What happens after my J1 program ends?

After your program completion date listed on the DS-2019, you have a 30-day 'grace period' to travel within the U.S. and prepare for departure. You cannot work during this grace period. If you wish to stay longer, you must apply for a change of status (e.g., to a Tourist visa or Student visa) before your grace period expires.
